1. Acceptance of these terms

These Terms & Conditions govern access to and use of the PromptGem website, web app, prompt library and related features (collectively, the “Service”). By using the Service, you agree to these terms and the Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be legally capable of entering into these terms. A minor may use the Service only with the involvement and permission of a parent or legal guardian and in accordance with the rules of any third-party AI tool used.

3. Nature of the Service

The Service helps users discover, save, copy, share and adapt prompts for third-party AI tools. Digonest does not operate those third-party models and does not control their availability, policies, training data or outputs.

4. No guarantee of AI output

AI-generated results can be inaccurate, biased, offensive, incomplete, unexpected or legally restricted. Prompts do not guarantee a particular image, video, style, quality or commercial result. You are responsible for reviewing outputs and deciding whether they are suitable, lawful and safe for your intended use.

5. Acceptable use

You must not use the Service to create, promote or facilitate unlawful activity; exploitation or abuse; non-consensual sexual content; sexual content involving minors; credible threats; self-harm encouragement; hate or targeted harassment; fraud, impersonation or deception; malicious code; privacy violations; or infringement of intellectual-property or other rights.

6. Prompt and site content

The Service’s original selection, organization, interface, branding, text and other materials are owned by Digonest or used with permission. Individual ideas, facts, third-party names and user-accessible AI concepts may be subject to separate rights. These terms do not transfer ownership of Digonest’s Service or branding to you.

7. Your submissions

When you submit a contact message, report, suggestion or other material, you confirm that the information is accurate and that you have the right to provide it. You authorize Digonest to use the submission as reasonably necessary to provide support, investigate reports, improve the Service and comply with law. Do not submit confidential information unless it is necessary.

8. Third-party services and links

The Service may link to Gemini, ChatGPT, app stores, advertisers or other websites. Their own terms, privacy practices, content rules and charges apply. Digonest is not responsible for third-party services or transactions.

9. Advertising

The Service may display banner, interstitial, rewarded, native or other advertising. Ad availability and format may vary by device and configuration. Advertising does not change your responsibility for reviewing external offers before interacting with them.

10. Availability and changes

Digonest may add, modify, suspend, restrict or remove prompts, categories, features or the Service at any time. We do not guarantee uninterrupted or error-free availability, permanent storage of favorites or history, or compatibility with every browser, device or third-party tool.

11. Reports and enforcement

Digonest may investigate suspected violations and may edit, hide, remove or preserve content and records where reasonably necessary. Submitting a report does not guarantee a specific outcome. Misuse of reporting or contact systems may be restricted.

12. Disclaimer

To the maximum extent permitted by law, the Service is provided on an “as is” and “as available” basis without warranties of accuracy, fitness for a particular purpose, non-infringement or uninterrupted operation. Nothing in these terms excludes rights or remedies that cannot legally be excluded.

13. Limitation of liability

To the maximum extent permitted by law, Digonest and its owner, personnel and service providers will not be liable for indirect, incidental, special, consequential or punitive losses, loss of data, lost profits, reputational harm, or harm arising from third-party AI outputs or services. Any liability that cannot be excluded will be limited as permitted by applicable law.

14. Indemnity

You agree to be responsible for claims, losses and reasonable costs arising from your unlawful use of the Service, your content or submissions, or your violation of these terms or another person’s rights, to the extent permitted by law.

15. Governing law and disputes

These terms are governed by the laws of India. Subject to any mandatory consumer forum or other jurisdiction required by law, disputes will be subject to the competent courts in Jharkhand, India. Before filing a claim, you are encouraged to contact Digonest so the issue can be reviewed.

16. Changes to these terms

We may update these terms when the Service, law or business practices change. The effective date above will be revised. Continued use after an update means you accept the revised terms where permitted by law.
